Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of TappSmart, operated by Tapp Solutions, LLC ("we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Eligibility

You must be at least 13 years old to use TappSmart. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Be responsible for all activities under your account.

Acceptable Use

You agree not to use TappSmart to:

• Violate any applicable laws or regulations.
• Infringe on intellectual property rights of others.
• Transmit harmful, offensive, or misleading content.
• Attempt to gain unauthorized access to our systems.
• Interfere with the proper functioning of the platform.
• Engage in spamming or unsolicited communications.
• Impersonate any person or entity.

User Content

You retain ownership of content you upload to TappSmart ("User Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide our services.

You are solely responsible for your User Content and represent that you have all necessary rights to share it. We reserve the right to remove content that violates these Terms.

Subscription and Payments

Some features require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase.
• Provide accurate billing information.
• Authorize recurring charges for subscription plans.

Subscriptions automatically renew unless cancelled before the renewal date. Refunds are provided in accordance with our refund policy.

NFC Cards and Physical Products

Physical NFC cards and products are sold separately. All sales are final unless the product is defective. Shipping times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers.

Intellectual Property

TappSmart and its content, features, and functionality are owned by Tapp Solutions, LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Disclaimer of Warranties

TappSmart is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure. Your use of the service is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Tapp Solutions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TappSmart. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Tapp Solutions, LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of TappSmart or violation of these Terms.

Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use TappSmart ceases immediately. Provisions that by their nature should survive termination will remain in effect.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or a notice on our platform. Continued use of TappSmart after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in Bergen County, New Jersey.
